Delaware's Healthy Delaware Families Act provides eligible employees up to 12 weeks of paid family leave (bonding, military) and up to 6 weeks of medical leave per year. Employee and employer contributions begin January 2025 and benefits begin January 2026. Employers with fewer than 10 employees are exempt from the family leave component.
Delaware Discrimination in Employment Act
Delaware's DDEA applies to employers with 4 or more employees and provides broader protections than federal Title VII, covering race, marital status, genetic information, sexual orientation, gender identity, and other categories not fully covered federally.
Delaware Healthy Workplace Act
Delaware employers with 10 or more employees must provide up to 40 hours of paid sick and preventive care leave per year to full-time employees. Leave accrues at 1 hour per 30 hours worked. Leave can be used for medical care, preventive health, domestic violence, and public health emergencies.
Delaware Wage Payment and Collection Act
Delaware requires employers to pay wages at least monthly (or more frequently if the employment contract specifies) and must provide a written wage statement each pay period. Final pay upon termination must be provided on the next regular payday.
